This “Privacy Policy” explains how A3Code (“Company” or “we”) collects, uses, discloses, and otherwise processes personal data on behalf of our customers – typically, merchants (any, a “Merchant”) – in connection with our application, A3Code, which runs on the Clover Point of Sale system (“Clover POS”). This Privacy Policy does not apply to Company’s privacy practices in any other context.

Information We Collect

We may collect personal data from or on behalf of Merchants, including:

  • Information collected during transactions via Clover POS, such as payment details, merchant location, transaction amount, and purchased goods or services.
  • Additional information provided through Clover POS, including customer contact details, marketing preferences, and loyalty program activities.
  • Data about Merchant personnel interactions with the Clover POS, such as clock-in/out times and tips earned.

How We Use the Information We Collect

We use the personal data collected to:

  • Provide and improve our application.
  • Respond to inquiries and support requests.
  • Comply with legal obligations and protect against fraudulent activity.

How We Share Information

We may share collected personal data with:

  • The Merchant from whom it was collected.
  • The Clover POS platform, per its Privacy Notice.
  • Third-party service providers assisting in application management.

Data Subject Rights

Individuals should contact the Merchant regarding their data rights. Clover is also responsible for responding to data requests as per its Privacy Notice.

Additional Information for Merchants Located in Europe

Controller

A3Code acts as a data processor for Merchants using our application. Merchants control the data we process on their behalf.

Cross Border Data Transfer

We implement appropriate safeguards when transferring personal data outside of Europe, such as Standard Contractual Clauses.
